A Viewer Writes: Wicomico Sheriff's Department Above The Law?

One of Mike Lewis' finest riding around without a third break light. I see him every single morning on the way to work. I called the sheriffs office last week to let them know. Still not fixed. If it were me I would've been pulled over and slapped with a repair order. I forgot, they are above the law.

I see people every day with a bulb out, day time running light. Not a federal offence. Maybe he don't even know its out. Go report drug dealers instead.

See them in personal vehicles talking on the phone. Puts us all in danger. They are no more skilled than I in operating a vehicle. If outlawed for cited safety should apply equally and without exception.

If the other two work, is there a legit reason to ticket for a repair order? You done did your citizen by taking time to call about non functioning light. IMO not a drawer twisting event.

See FD personnel wrote a letter to the Times. Street talk is others have not posted it, yet.

Not exactly true, under COMAR, all vehicles manufactured after September 1, 1985 are required to have a center high mounted stop lamp.

Curious about two things: where in Wicomico County is there a five lane road in a commercially developed area, with all those overhead signs; and, second, when did Sheriff Lewis switch from buying Tahoes to Mitsubishi Outlanders? There is also no sign of a light bar on the vehicle.

Ya but what scares me worse is seeing them operating a 17" laptop screen running 75 down rt.50 . When I see them I point and shake my head that normally makes them laugh at me. As for being more skilled drivers they are far from it there class is less than two weeks on learning to drive and operate a vehicle as well as using as an offensive tool and defensive tool.

9:26 just becasue a law for safety says manufactures have to have 3 break lights, there is no law that says the top third light has to be working and is subject to a repair order or being stopped... Again you didn't look up the law... You must be a cop for the way you try to twist words and twist some of the law...

9:30 Everything is manufactured you idiot, even the carpet in the car, so are you saying if your carpet is not working, or in working order or is all ripped up you can or should be stopped for that??? You too must be a cop for trying to use some law for your agenda or how you twist the law to work for you...

That is why cops are cowards, They are scared of video cameras and they hate the constitution... They get paid to ruin people's lives and they laugh and fist bump doing it, saying they are helping the community or protecting you... And you all praise them and call them heroes... I never known a hero who gets paid to ruin peoples lives and does it happily and goes out of their way to do it... I never seen a hero say they are helping you at the same time they abuse you... Sure there are bad people and bad people in jobs with power, it is how you deal with and use that power that says things about you... They lie to you to get you in trouble versus having actual evidence most of the time... Wither they are being told what to do or just following orders...

Did look it up and the high mount stop lamp (center brake light) is absolutely required on vehicles manufactured after September 1, 1985. It is subject to repair orders. A vehicle would fail a Maryland State Inspection if that light did not work.

Hey Einstein! The picture is in front on the Centre northbound. Dodge emblem clearly visible. And it's an unmarked vehicle so it wouldn't have a light bar.

Maryland: Court Upholds Traffic Stop Over Third Brake Light
Second highest court in Maryland holds driving without a third brake light is inherently unsafe.

Third brake light
Police in Maryland can stop and interrogate a driver if he is driving a car with a burned out third brake light. The Court of Special Appeals ruled earlier this month that allowing the car to continue with only two functional brake lights would pose a safety hazard to the public.

The three-judge panel came to this conclusion in resolving the November 30, 2011 traffic stop of Marlon Smith in the city of Baltimore. Detective Kenneth Ramberg had been watching Smith as he walked on Darley Avenue, but he could not stop him because he was not engaged in any criminal behavior. Once Smith got in the passenger seat of a car with a broken rear deck brake light, Detective Ramberg pulled the car over.

The detective said he smelled marijuana and ordered both of its occupants out of the car. As he started looking inside the car, he spotted a handgun that belonged to Smith. Maryland does not allow citizens to carry a firearm except in rare circumstances. Smith appealed the firearms possession conviction, arguing the initial stop was invalid because state law only requires a vehicle to have two functioning brake lights.

"Every motor vehicle registered in this state and sold as a new vehicle after June 1, 1967, shall be equipped with at least two stop lamps," Maryland Code Section 22-206 states.

The court countered by citing a generic statute that allows an officer to issue an "equipment repair order" if a Maryland-registered vehicle does not meet state standards. The judges then cited Code of Maryland Regulations 11.14.02.10 which instructs state vehicle inspectors to fail cars made after 1985 if they do not have a functioning third brake light.

"Assuming arguendo that the traffic violation in this case was predicated solely on the Motor Vehicle Administration regulation, the stop was justified nonetheless on the basis that the vehicle was driven in an unsafe condition," Judge Irma S. Raker wrote for the court. "An officer is authorized to stop a vehicle that is being driven in an unsafe condition."

The court then cited research that claims the third brake light reduces rear-end collisions, and creating a condition that increases rear-end collisions is inherently unsafe.

"A study conducted by the NHTSA found that from 1986 to 1995, the high-mounted brake light reduced the frequency of rear impact accidents in every year the study was conducted," Raker wrote. "Therefore, even with two functioning rear brake lights, the specific safety advantages of the center high-mounted brake light demand that it function properly."

Y'all that are defending the cops obviously don't pay much attention. They break so many laws on a daily basis it's ridiculous. Speeding,unsafe lane changes, no seatbelt, no turn signals, distracted driving, intimidation,lying, etc,etc. BUT.....its all good because they need to do that to protect us from criminals 🙄

Cop or sheriff or any law abiding citizen should be required to adhere to all laws no matter how big or small . A badge doesn't make u any less accountable for the maintenance of ur vehicle. What's good for civilians is good for officers . Every one is greatful for the job these men and women do everyday but they are not above the law
